Özet
İşyeri devri; işyerinin veya bir bölümünün bir hukuki işleme dayanarak iş sözleşmesine dayalı bütün hak ve borçlarıyla bir başka işverene devredilmesi durumudur. İşyerinin devri sonrasında iş ilişkilerinin geçişi hususu 4857 sayılı İş Kanunu m.6 ve 6102 sayılı TTK m.178 içeriğinde düzenlenmektedir. Çalışma kapsamında, uygulamada sık sık karıştırılan ve birbirlerinin yerlerine kullanılan söz konusu kanun hükümlerinin farklılıklarına işaret edilmektedir. Çalışmada; işyeri devri kavramı, benzer üçlü ilişkilerle kıyaslanmak suretiyle açıklanarak, işyeri devrine sebep olan yapısal değişiklik halleri irdelenerek işverenlerin sorumlulukları ele alınmaktadır. İşyeri devri, TTK m.178 hükmü kapsamında, yapısal değişiklik halleri özelinde ve Yargıtay kararları ışığında irdelenerek çözüm önerileri sunulmuştur.
The subject of workplace transfer can be defined as handover of the workplace as a whole or part of it to another employer with all rights and debts in accordance with the employment contract by law. The issue of the transition of business relations after the transfer of the workplace is regulated in the Article 6 of the Labor Law No. 4857 and Article 178 of the TTK No. 6102. Within the scope of the study, it is pointed out the differences of the provisions of the said law, which are frequently confused in practice and used interchangeably. In the study; workplace turnover concept; The responsibilities of employers are discussed by explaining by comparing them with similar triangular relationships and by examining the structural changes that cause workplace transfer. Workplace transfer was examined and proposed solutions in the light of the decisions of the Supreme Court, in the case of structural changes, within the scope of the article 178 of the TTK.
