Özet
Düşüncenin özünün, bilgi olduğu aşikardır. Düşünce ve bilginin, zihinle bağlantılı olan ve insanın doğasında yer
alan yatkınlık ve istidatlardan biri olduğu ifade edilmektedir. Bu bağlamda düşüncenin, zihinsel olarak, fikirlerin
üretilmesine dayanan bir süreç olduğu bilinmektedir. Sistematik ve tutarlı bilgiler bütününden oluşan bilimin
ise, insanlık yararına olması gerektiği savunulmaktadır. Dolayısıyla; bilimde ve bilimsel araştırmalarda ilerleme
ve gelişmenin sağlanabilmesi adına; bilimin, her türlü desiseden uzak kalması önem arz etmekte ve bilim
insanlarının da söz konusu hususta mutabık olduğu düşünülmektedir. Zira, bilimsel araştırmaların, akademik
yaşamda en temel yapı taşları arasında “etik” kavramı yer almaktadır. Bu bağlamda; teknolojik anlamdaki
ilerlemelerin, gelişmelerin ve internet kullanımının da yaygınlaşmasıyla birlikte; çok sayıda öğrencilerimizin,
akademisyenlerimizin ödevlerinin, tezlerinin, proje ya da bilimsel eserlerinin “etik olmayan davranışlar” olarak
kategorize edilen intihal eylemi olarak değerlendirilebileceği aşikardır.
Bu çalışmada, “Bilimsel Etik ve Türk Hukukunda İntihal” meselesinden bahsedilmiştir. Buna paralel olarak, ilgili
hususlarda; temel sorunlar incelenmiş olup, çözüm önerileri vurgulanmıştır. İlk bölümlerde, “bilgi, bilim ve
bilimsel bilgi, iletişim ve bilimsel iletişim, araştırma ve bilimsel araştırma, etik ve bilimsel etik”, sonraki bölümlerde
ise; “intihal ve iktibas kavramları, intihal türleri, intihal nedenleri, intihal örnekleri, intihalin önlenmesi, özgünlük
kriterleri, telif hakkı, mevzuat kapsamında düzenlemeler ve müeyyideleri” konularına değinilmiştir.
It is clear that the essence of thought is knowledge. It is stated that thought and knowledge are one of the aptitude or abilities that are inherent in human nature. In this context, it is known that thought is a process based on the production of ideas mentally. It is argued that science consisting of systematic and consistent information should benefit humanity. Therefore, in order to ensure progress and development in science and scientific research, it is important for science to stays away from all kinds of fraud and it is thought that scientists are in agreement on this issue. Because the concept of “Ethics” is among the basic building blocks of scientific research in academic life. In this content; with the technological advances developments and the widespread use of the internet; it is obvious that many of your students and academics, assignments, theses, projects or scientific works can be considered as plagiarism, which is categorized as unethical behavior. In this review article, the subject of “Scientific Ethics and Plagiarism in Turkish Law” is mentioned. In parallel, the main problems in the related issues were examined and solution suggestions were emphasized. “Information, Science and Scientific Information, Communication and Scientific Communication, Research and Scientific Research, Ethics and Scientific Ethics” in the first sections, “Subsequent Plagiarism and Quotation Concepts, Types of Plagiarism, Reasons for Plagiarism, Examples of Plagiarism, Prevention of Plagiarism and Solution Suggestions, Criteria of Authenticity, Copyright, Regulations and Sanctions within the Scope of Legislation.”
