| dc.description.abstract | İflasa tabi bir tacirin borcunu ödeyemez duruma gelmesi halinde iflas kararı verilebilecektir. İflasa tabi kişi(ler), iflas kararından sonra müflis olacaktır. Buna mukabil bir iflas masası oluşturulur. Alacaklılar da belli sıraya girer ve bu alacaklarını iflas masasından talep ederler. Dolayısıyla bu suçun bireysel koruma sağladığı öngörülebilir. Anayasamızda da hiç kimsenin sözleşme sorumluluğunu yerine getirememesinden dolayı özgürlüğünden alıkonulamayacağı ifade edilmiştir. | dc.description.abstract | A bankrupt decision can be made if a trader subject to bankrupt fails to pay his debt. The bankrupt(s) will be bankrupt after the bankruptcy decision. On the other hand, a bankruptcy table is created. Creditors also come in a certain order and demand these from the bankruptcy desk. Therefore, it can be predicted that this crime provides individual protection. It is stated in our Constitution that no one can be detained because of not being able to fulfill the responsibility of the contract.
